This Privacy Policy describes how Lively Integrated Health, LLC ("we," "our," "us") collects, uses, and protects information when you visit our website, submit forms, or opt into our SMS program ("Site"). This policy applies to website visitors only.

Important: If you are or become a patient of Lively Integrated Health, your protected health information (PHI) is governed by our HIPAA Notice of Privacy Practices and the privacy and consent documents you sign at intake — not this website policy. This policy covers information collected through the Site before or outside of a patient relationship.

1. Information We Collect

Information you provide directly:

-Name, email address, and phone number submitted through contact forms, appointment request forms, or SMS opt-in forms

-Any message content you choose to include in a form submission

-Newsletter or marketing sign-up information

Information collected automatically:

-IP address, browser type, device type, and operating system

-Pages visited, time spent on the Site, and referring website

-Cookies and similar tracking technologies (see Section 5)

We do not collect medical or health information through this website. Please do not submit health details through website contact forms; clinical communication takes place through our secure, HIPAA-compliant channels once you become a patient.

2. How We Use Your Information

We use information collected through the Site to:

-Respond to inquiries and appointment requests

-Send appointment reminders and clinic updates if you opt in

-Send marketing and promotional messages if you opt in (see our Terms & Conditions for SMS program details)

-Operate, maintain, and improve the Site

-Comply with legal obligations

3. SMS Communications

If you opt into our SMS program through the Site, your phone number and consent records are used to deliver the messages described in our Terms & Conditions. You may opt out at any time by replying STOP. Reply HELP for assistance. Message and data rates may apply. Clinical text communication with established patients is conducted through Spruce, a HIPAA-compliant communication platform.

We do not sell or share your phone number or SMS consent data with third parties for their marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services.

4. How We Share Information

We do not sell your personal information. We share information only with:

Service providers who help us operate the Site and communicate with you, including our website hosting platform WordPress, SMS/communication provider Spruce Health, and email service provider Microsoft Outlook.

Practice management systems: if you request an appointment, your contact information may be entered into our electronic medical record and practice management system (OptiMantra) to schedule you; payment processing is handled by Authorize.net, Cliq, and Stripe, and we do not store full payment card numbers on our own systems.

Legal requirements: when required by law, subpoena, or to protect our legal rights

Business transfers: in connection with a merger, sale, or transfer of practice assets, subject to applicable law

5. Cookies and Tracking Technologies

Our Site uses cookies and similar technologies for basic functionality and analytics.

We use Google Analytics and Go High Level to understand Site traffic. These tools collect anonymized usage data.

We use Meta Pixel / Google Ads tags for advertising measurement. 

You can control cookies through your browser settings. Disabling cookies may affect Site functionality.

6. Data Security

We use reasonable administrative, technical, and physical safeguards to protect information collected through the Site. However, no internet transmission is completely secure, and we cannot guarantee absolute security of information transmitted through the Site.

7. Data Retention

We retain website form submissions and SMS consent records for as long as needed to fulfill the purposes described in this policy, comply with legal and regulatory obligations (including telecommunications consent record requirements), and resolve disputes.

8. Your Choices and Rights

You may:

-Opt out of SMS messages at any time by replying STOP

-Unsubscribe from marketing emails via the link in any email

-Request access to, correction of, or deletion of personal information we collected through the Site by contacting us at the information below

We will honor requests consistent with applicable law. Note that patient medical records are governed by separate medical record retention laws and cannot be deleted upon request.

9. Children's Privacy

Our Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. If you believe a child has submitted information to us, contact us and we will delete it.

10. Third-Party Links

Our Site may link to third-party websites (including scheduling, supplement dispensary, or social media platforms). We are not responsible for the privacy practices or content of those sites. Review their privacy policies before providing information.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated policy.
